Agreement for sale: clauses to check before signing
The agreement decides what you can enforce later. These are the clauses to read closely.
- Exact plot number, dimensions, facing and survey numbers.
- Total price, with every charge listed.
- Payment schedule linked to milestones.
- Development works promised, with dates.
- Date of sale-deed registration.
- Cancellation, refund and interest terms on both sides.
- Consequences of delay by the promoter.
- RERA registration number and reference to the approved plan.
Under the RERA Act, a promoter cannot take more than 10% of the cost as an advance without a registered agreement for sale.
